  1. Introduction

Welcome to Ubisco Co., Ltd., operating under the brand My Thai 24. By accessing or using our website and services, you agree to be bound by these Terms and Conditions. These terms govern your use of our website and all services we provide, including visa and immigration consulting, marriage and family support, relocation and expatriate assistance, driving license facilitation, bank account support, real estate services, and intercultural and telephone consulting, other administrative support services and business consulting services. If you do not agree to these Terms, you should not use our services.

  1. Definitions

In these Terms, the term “Client,” “User,” or “You” refers to any individual or organization engaging our services. The term “Services” refers to all consulting and administrative support services offered by Ubisco Co., Ltd., which include visa and immigration assistance, marriage and family services, relocation and expat support, real estate guidance, bank account facilitation, driving license assistance, as well as intercultural and telephone consulting. “Third-Party Providers” refers to government offices, embassies, law firms, real estate agencies, banks, airlines, hotels, and any other external parties that may be involved in delivering or facilitating related services.

  1. Eligibility

To use our services, you must be of legal age and have the legal capacity to enter into agreements. By engaging our services, you confirm that all information you provide to us is accurate and complete. For services related to marriage, you further confirm that you are legally eligible to marry under Thai law and the laws of your home country.

  1. Scope of Services

Ubisco Co., Ltd. offers a range of services designed to assist clients with complex administrative and cultural processes in Thailand. Our visa and immigration support includes preparing documentation and guiding you through the submission process; however, we are not a law firm and do not provide legal representation or guarantee visa approval, as final decisions are made by the relevant authorities. Our marriage and family services cover legal marriage registration, prenuptial agreements, uncontested divorce, and paternity acknowledgment. In all cases, we act as consultants and facilitators and do not represent clients in court proceedings.

For clients relocating to Thailand, we provide support such as housing search assistance, orientation, school searches, and settling-in services. We do not assume responsibility for contracts, lease agreements, or financial commitments you make. Our driving license facilitation service helps clients navigate the Thai licensing system, but final approval lies with government authorities. Similarly, our bank account support is limited to administrative assistance; approval is at the discretion of the bank.

Real estate advisory services include identifying suitable properties and liaising with agents; however, we do not offer legal or financial guarantees related to property purchases or rentals. Finally, our intercultural and telephone consulting services provide practical advice based on extensive experience in Thailand. This advice is for guidance and should not be considered legal or official advice.

Our business consulting division assists entrepreneurs, investors, and companies in setting up and operating businesses in Thailand. Services include company formation support, investment consulting, market-entry strategies, compliance consultation, and operational planning. We also provide support for licensing, tax registration, and corporate governance requirements. Please note that we act as consultants and not as legal representatives. Clients are responsible for ensuring compliance with all relevant Thai laws and regulations.

  1. Payments and Fees

All service fees must be paid in full and in advance, unless otherwise agreed upon in writing. Our fees do not include any third-party costs, such as government charges, translation services, or courier fees, unless specified. If any payment falls short due to bank or intermediary deductions, the client is responsible for covering the difference.  We are not responsible for tracking missing amounts or explaining bank deductions. Work will not commence until the full payment has been received in our account. All payments are non-refundable, except as outlined in the cancellation policy below.

  1. Notes and Limitations

While we make every effort to provide accurate guidance and support, we cannot guarantee the success of any application, registration, or transaction, as these depend on factors beyond our control, including decisions made by government agencies and third parties. For this reason, clients should not book flights, accommodations, or make other irreversible arrangements until they have received their passport with the relevant visa or official confirmation of the process in hand. Please note that our service fees cover only our consulting and administrative assistance. Government fees, embassy charges, courier costs, and third-party expenses are not included unless explicitly stated in writing. We are also not liable for delays caused by government agencies, policy changes, third-party actions, or force majeure events. In the unlikely event that an issue arises, our liability is limited strictly to the amount paid for the specific service provided, and we cannot be held responsible for indirect or consequential losses.

  1. Third-Party Services

In some cases, our services involve coordination with third parties such as law firms, government agencies, or real estate providers. These entities operate independently and under their own terms. While we strive to work only with trusted partners, we cannot be held responsible for their performance, accuracy, or reliability, nor are we liable for any losses or damages caused by third-party providers.

  1. Client Responsibilities

It is the client’s responsibility to provide accurate and complete information and documentation as requested, and to respond promptly to our communications. Clients must ensure that all their actions comply with Thai law and, where applicable, the laws of their home country. We are not responsible for delays or complications resulting from incorrect or incomplete information provided by the client.

  1. Cancellation and Refund Policy

Refunds are only possible if our service has not yet started. A service is considered started once we have provided any guidance, sent instructions or documentation by email or messenger, or begun the preparation of documents. Government fees, third-party charges, and courier costs are never refundable under any circumstances. For telephone or consulting sessions, cancellations made more than 24 hours before the scheduled appointment will receive a full refund, while cancellations made within 24 hours will not be eligible for any refund. All cancellation requests must be made in writing.

  1. Confidentiality and Data Protection

We respect the privacy of our clients and handle all personal data in accordance with applicable data protection laws and our Privacy Policy. Your information will only be used for the purpose of delivering the agreed services and will not be disclosed to third parties unless required by law or necessary for the provision of the service.

  1. Intellectual Property

All documents, templates, and materials provided by Ubisco Co., Ltd. remain our property and are intended solely for the client’s personal use. They may not be copied, shared, or redistributed without our prior written consent.

  1. Termination of Services

We reserve the right to terminate services without refund if a client provides false information, engages in fraudulent or illegal activity, or breaches these Terms. Clients may terminate services by providing written notice; however, refunds will only be issued according to the cancellation policy outlined in Section 9.

  1. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Thailand. Any disputes arising out of or related to these Terms shall fall under the exclusive jurisdiction of the courts in Bangkok, Thailand.

ยินดีต้อนรับสู่ บริษัท Ubisco จำกัด ซึ่งดำเนินงานภายใต้แบรนด์ My Thai 24 โดยการเข้าถึงหรือใช้เว็บไซต์และบริการของเรา ถือว่าคุณตกลงที่จะปฏิบัติตามข้อกำหนดและเงื่อนไขเหล่านี้ ข้อกำหนดนี้ใช้บังคับกับการใช้เว็บไซต์และบริการทั้งหมดของเรา รวมถึงบริการให้คำปรึกษาด้านวีซ่าและการตรวจคนเข้าเมือง การสนับสนุนด้านการแต่งงานและครอบครัว บริการช่วยเหลือการย้ายถิ่นฐาน การขับขี่ การอำนวยความสะดวกในการเปิดบัญชีธนาคาร บริการอสังหาริมทรัพย์ บริการให้คำปรึกษาด้านวัฒนธรรมและการติดต่อทางโทรศัพท์ รวมถึงบริการสนับสนุนด้านธุรการและการให้คำปรึกษาทางธุรกิจ หากคุณไม่ยอมรับข้อกำหนดเหล่านี้ กรุณางดใช้บริการของเรา

คำนิยาม (Definitions)
ในข้อกำหนดนี้ คำว่า “ลูกค้า,” “ผู้ใช้,” หรือ “ท่าน” หมายถึง บุคคลหรือนิติบุคคลที่ใช้บริการของเรา คำว่า “บริการ” หมายถึง บริการให้คำปรึกษาและสนับสนุนด้านธุรการทั้งหมดที่บริษัท Ubisco จำกัด ให้บริการ ซึ่งรวมถึงการช่วยเหลือด้านวีซ่าและการตรวจคนเข้าเมือง บริการครอบครัวและการแต่งงาน การสนับสนุนการย้ายถิ่นฐานและชาวต่างชาติ การให้คำแนะนำด้านอสังหาริมทรัพย์ การช่วยเหลือเปิดบัญชีธนาคาร การอำนวยความสะดวกในการขอใบขับขี่ และการให้คำปรึกษาด้านวัฒนธรรมและการสื่อสารทางโทรศัพท์ “ผู้ให้บริการบุคคลที่สาม” หมายถึง หน่วยงานราชการ สถานทูต สำนักงานกฎหมาย ตัวแทนอสังหาริมทรัพย์ ธนาคาร สายการบิน โรงแรม และบุคคลภายนอกอื่น ๆ ที่เกี่ยวข้องในการให้บริการ

คุณสมบัติ (Eligibility)
เพื่อใช้บริการของเรา คุณต้องบรรลุนิติภาวะและมีความสามารถทางกฎหมายในการทำสัญญา โดยการใช้บริการของเรา ถือว่าคุณยืนยันว่าข้อมูลที่คุณให้กับเรานั้นถูกต้องและครบถ้วน สำหรับบริการที่เกี่ยวข้องกับการแต่งงาน คุณยืนยันเพิ่มเติมว่าคุณมีสิทธิ์ตามกฎหมายในการแต่งงานตามกฎหมายไทยและกฎหมายของประเทศตนเอง

ขอบเขตของบริการ (Scope of Services)
บริษัท Ubisco จำกัด ให้บริการสนับสนุนลูกค้าในการดำเนินงานด้านธุรการและวัฒนธรรมในประเทศไทย เช่น บริการด้านวีซ่าและการตรวจคนเข้าเมือง โดยช่วยจัดเตรียมเอกสารและให้คำแนะนำในการยื่นคำขอ อย่างไรก็ตาม เราไม่ใช่สำนักงานกฎหมายและไม่ให้บริการด้านกฎหมายหรือรับประกันการอนุมัติวีซ่า เนื่องจากการตัดสินใจขึ้นอยู่กับหน่วยงานที่เกี่ยวข้อง บริการด้านครอบครัวและการแต่งงานครอบคลุมการจดทะเบียนสมรส การทำสัญญาก่อนสมรส การหย่าโดยยินยอม และการรับรองบุตร เราเป็นเพียงที่ปรึกษาและผู้ประสานงาน ไม่เป็นตัวแทนในศาล

สำหรับลูกค้าที่ต้องการย้ายถิ่นฐานไปยังประเทศไทย เราให้การสนับสนุนเช่น การหาที่พัก การปฐมนิเทศ การค้นหาโรงเรียน และบริการช่วยเหลือต่าง ๆ แต่เราไม่รับผิดชอบต่อสัญญา การเช่า หรือข้อผูกพันทางการเงินของลูกค้า บริการอำนวยความสะดวกในการทำใบขับขี่เป็นเพียงการให้คำแนะนำ ไม่สามารถรับประกันการอนุมัติ เนื่องจากขึ้นอยู่กับหน่วยงานของรัฐ บริการช่วยเปิดบัญชีธนาคารเป็นเพียงการช่วยเหลือด้านธุรการ การอนุมัติขึ้นอยู่กับดุลยพินิจของธนาคาร

บริการที่เกี่ยวข้องกับอสังหาริมทรัพย์ครอบคลุมการแนะนำทรัพย์สินและการประสานงานกับตัวแทน แต่เราไม่รับผิดชอบทางกฎหมายหรือการเงินเกี่ยวกับการซื้อหรือเช่า บริการให้คำปรึกษาด้านวัฒนธรรมและการสื่อสารเป็นเพียงคำแนะนำตามประสบการณ์ ไม่ถือเป็นคำแนะนำทางกฎหมายอย่างเป็นทางการ

ฝ่ายที่ปรึกษาทางธุรกิจของเราช่วยผู้ประกอบการ นักลงทุน และบริษัทในการจัดตั้งและดำเนินธุรกิจในประเทศไทย บริการรวมถึงการสนับสนุนการจัดตั้งบริษัท การให้คำปรึกษาด้านการลงทุน กลยุทธ์เข้าสู่ตลาด การให้คำปรึกษาด้านการปฏิบัติตามกฎหมาย และการวางแผนการดำเนินงาน เรายังช่วยในเรื่องการขอใบอนุญาต การจดทะเบียนภาษี และการกำกับดูแลกิจการ โปรดทราบว่าเราเป็นเพียงที่ปรึกษา ไม่ใช่ตัวแทนทางกฎหมาย ลูกค้าต้องรับผิดชอบในการปฏิบัติตามกฎหมายไทยที่เกี่ยวข้องทั้งหมด

การชำระเงินและค่าธรรมเนียม (Payments and Fees)
ค่าบริการต้องชำระเต็มจำนวนและล่วงหน้า เว้นแต่จะมีการตกลงเป็นลายลักษณ์อักษร ค่าบริการของเราไม่รวมค่าใช้จ่ายของบุคคลที่สาม เช่น ค่าธรรมเนียมราชการ ค่าบริการแปลเอกสาร หรือค่าจัดส่ง เว้นแต่จะระบุไว้ หากยอดเงินที่โอนเข้ามาน้อยกว่าที่กำหนดเนื่องจากค่าธรรมเนียมธนาคาร ลูกค้าต้องรับผิดชอบจ่ายส่วนต่าง เราไม่รับผิดชอบติดตามยอดเงินที่หายไปหรืออธิบายค่าธรรมเนียมธนาคาร งานจะไม่เริ่มจนกว่าจะได้รับเงินครบถ้วน การชำระเงินทั้งหมดไม่สามารถขอคืนได้ ยกเว้นตามเงื่อนไขการยกเลิกที่ระบุไว้ด้านล่าง

หมายเหตุและข้อจำกัด (Notes and Limitations)
แม้ว่าเราจะพยายามให้ข้อมูลและคำแนะนำที่ถูกต้องที่สุด แต่เราไม่สามารถรับประกันความสำเร็จของการสมัคร การจดทะเบียน หรือธุรกรรมใด ๆ เนื่องจากขึ้นอยู่กับหน่วยงานราชการและบุคคลที่สาม ลูกค้าไม่ควรจองตั๋วเครื่องบิน ที่พัก หรือทำการจองที่ไม่สามารถยกเลิกได้จนกว่าจะได้รับหนังสือเดินทางพร้อมวีซ่าหรือการยืนยันอย่างเป็นทางการ ค่าบริการของเราครอบคลุมเฉพาะการให้คำปรึกษาและช่วยเหลือด้านธุรการ ไม่รวมค่าธรรมเนียมราชการ ค่าสถานทูต ค่าจัดส่ง หรือค่าใช้จ่ายของบุคคลที่สาม เว้นแต่จะระบุไว้เป็นลายลักษณ์อักษร เราไม่รับผิดชอบต่อความล่าช้าที่เกิดจากหน่วยงานราชการ การเปลี่ยนแปลงนโยบาย การกระทำของบุคคลที่สาม หรือเหตุสุดวิสัย ในกรณีที่เกิดปัญหา ความรับผิดชอบของเราจำกัดเฉพาะจำนวนเงินที่ลูกค้าชำระสำหรับบริการนั้น ๆ และไม่รับผิดชอบต่อความเสียหายทางอ้อม

บริการจากบุคคลที่สาม (Third-Party Services)
ในบางกรณี บริการของเราต้องประสานงานกับบุคคลที่สาม เช่น สำนักงานกฎหมาย หน่วยงานราชการ หรือผู้ให้บริการอสังหาริมทรัพย์ ซึ่งดำเนินงานภายใต้ข้อกำหนดของตนเอง เราไม่รับผิดชอบต่อผลงาน ความถูกต้อง หรือความน่าเชื่อถือของบุคคลเหล่านี้ และไม่รับผิดชอบต่อความเสียหายที่เกิดขึ้นจากการกระทำของพวกเขา

ความรับผิดชอบของลูกค้า (Client Responsibilities)
ลูกค้าต้องให้ข้อมูลและเอกสารที่ถูกต้องครบถ้วนตามที่ร้องขอ และตอบสนองต่อการติดต่ออย่างทันท่วงที ลูกค้าต้องปฏิบัติตามกฎหมายไทยและกฎหมายของประเทศตนเอง เราไม่รับผิดชอบต่อความล่าช้าที่เกิดจากข้อมูลที่ไม่ถูกต้องหรือไม่ครบถ้วนจากลูกค้า

นโยบายการยกเลิกและการคืนเงิน (Cancellation and Refund Policy)
การคืนเงินทำได้เฉพาะในกรณีที่บริการยังไม่เริ่มต้น โดยบริการถือว่าเริ่มต้นแล้วหากเราได้ให้คำแนะนำ ส่งคำชี้แจงหรือเอกสารทางอีเมลหรือแชท หรือเริ่มเตรียมเอกสาร ค่าธรรมเนียมราชการ ค่าบริการบุคคลที่สาม และค่าจัดส่งไม่สามารถคืนเงินได้ สำหรับการนัดหมายทางโทรศัพท์หรือการปรึกษา หากยกเลิกก่อน 24 ชั่วโมง จะได้รับเงินคืนเต็มจำนวน หากยกเลิกภายใน 24 ชั่วโมงจะไม่ได้รับเงินคืน การยกเลิกต้องแจ้งเป็นลายลักษณ์อักษรเท่านั้น

การรักษาความลับและการปกป้องข้อมูล (Confidentiality and Data Protection)
เรายึดมั่นในความเป็นส่วนตัวของลูกค้าและดำเนินการตามกฎหมายคุ้มครองข้อมูลที่เกี่ยวข้อง ข้อมูลของคุณจะถูกใช้เฉพาะเพื่อการให้บริการตามที่ตกลง และจะไม่ถูกเปิดเผยต่อบุคคลที่สาม เว้นแต่ตามกฎหมายกำหนดหรือจำเป็นเพื่อการให้บริการ

ทรัพย์สินทางปัญญา (Intellectual Property)
เอกสาร แม่แบบ และเนื้อหาทั้งหมดที่บริษัท Ubisco จำกัด จัดทำขึ้นยังคงเป็นทรัพย์สินของเรา และใช้สำหรับลูกค้าเท่านั้น ห้ามคัดลอก แจกจ่าย หรือเผยแพร่โดยไม่ได้รับความยินยอมเป็นลายลักษณ์อักษร

การยุติการให้บริการ (Termination of Services)
เราขอสงวนสิทธิ์ในการยุติการให้บริการโดยไม่คืนเงิน หากลูกค้าให้ข้อมูลเท็จ กระทำการฉ้อโกง หรือผิดกฎหมาย หรือฝ่าฝืนข้อกำหนดนี้ ลูกค้าสามารถยุติการใช้บริการได้โดยแจ้งเป็นลายลักษณ์อักษร อย่างไรก็ตาม การคืนเงินจะเป็นไปตามนโยบายที่ระบุไว้ในส่วนการยกเลิก

กฎหมายที่ใช้บังคับ (Governing Law)
ข้อกำหนดและเงื่อนไขนี้อยู่ภายใต้และตีความตามกฎหมายของประเทศไทย ข้อพิพาทที่เกิดขึ้นจะอยู่ในอำนาจศาลกรุงเทพมหานคร ประเทศไทย
